Getting into an auto accident is challenging in many ways. However, these challenges become more complicated for veterans with pre-existing issues. Veterans generally have similar legal rights to other persons involved in auto accidents. However, the following specific considerations affect veterans uniquely.
1. Right to Compensation
Veterans can seek compensation for injuries and property damage. Compensation is designed to cover various expenses and the resulting losses. Victims get compensation primarily for medical expenses and lost wages. Some victims can seek compensation for pain and suffering.
However, veterans with pre-existing conditions can file additional claims if the accident aggravates them. Most retirees have pre-existing conditions that auto accidents exacerbate.
Such retirees are entitled to compensation for the worsening of these conditions. This should cover the additional medical care needs and pain and suffering.
That aside, several laws affect veterans’ right to compensation. For instance, the USERRA protects them from workplace discrimination. This act excuses veterans from disciplinary actions if they miss work due to accident-related injuries. ADA provisions also require workplace environments to have reasonable accommodations for veterans with disabilities. Knowing these rights and resources available is important for veterans to navigate the aftermath of the accident with ease.
2. Right to Medical Care
Veterans also have a right to receive medical care for injuries resulting from accidents. However, unlike other individuals, the right to treatment is backed by several sources, including private insurance providers and the Department of Veteran Affairs. The VA essentially provides comprehensive medical services to injured veterans.
They can seek immediate medical attention and other services from VA-accredited hospitals and clinics. They can also go there for follow-up appointments. If the accident exacerbates pre-existing conditions, the VA can provide enhanced care. Affected veterans are also eligible for a higher disability rating and associated benefits.
Besides VA benefits, veterans can use their private insurance to cover medical expenses. However, this requires coordination between private insurers and VA benefits to mitigate cover duplication. Private insurance is mostly used to cover injuries that require out-of-network care.
3. Right to Legal Representation
Veterans also have a right to seek legal representation to help them navigate personal injury claims and insurance disputes. Working with an experienced lawyer like car accident attorney Stephen Babcock makes a significant difference. It also ensures veterans receive fair compensation and their rights are respected.
Besides personal injury expertise, veterans should choose an attorney versed in veteran cases. The lawyer should have a track record of successfully handling cases that involve veterans. However, veterans are fortunate as they can explore various resources for their legal needs.
For instance, the Veterans Service Organizations often provide legal resources and refer veterans to qualified lawyers. Most legal aid organizations also offer low-cost or free legal services to veterans.
Endnote
Handling auto accidents can prove challenging for veterans, who could be battling unique physical and financial burdens. Knowing their rights and the available resources can ease this
process. Veterans should leverage all the available support offered by VA, VSOs, and state resources to ensure they receive the care and compensation they deserve.
